Da família patriarcal à contemporânea. Entre o vellho e o novo: o surgimento dos novos arranjos familiares

Resumo

O presente artigo propõe uma dupla abordagem da família levando em consideração o caráter socioantropológico e também histórico-evolutivo da legislação brasileira. Tem como objetivo interrogar a ideia de crise na ou da família em razão das mudanças verificadas em sua constituição: abandonou-se o modelo patriarcal, único existente no passado, que cedeu o passo aos modelos diversos, dos quais se originaram os novos arranjos familiares. O texto cuida da família como o fenômeno social que nos é mais próximo. Nesse sentido, evidenciam-se os fatores que acarretaram as mudanças na família, como espelho/reflexo das mudanças operadas na própria sociedade. Para tanto, períodos distintos são considerados, enfatizando-se como marco legislativo a Constituição Federal de 1988. A partir de fontes bibliográficas nas áreas do saber já destacadas — direito, sociologia e antropologia — analisa-se a ideologia da família responsável pela sua representação naturalizada por meio de modelos ou padrões implicados na manutenção e conservação das estruturas sociais.

From the patriarchal family to the  modern one. Beteween the  old and the new: new family arrangements arise

The present article proposes a dual approach of the family taking into account the social-anthropological and the historical-evolutionary characters of the Brazilian legislation in order to interrogate the crisis idea
in the family due to changes in its constitution, by abandoning the old patriarchal model which made room to several new models, originating new family arrangements. The text is about the family as a social phenomenon that is close to us. In that sense, it becomes clear that there are factors that lead to changes in the family as a mirror reflection of the changes operated in the society. Therefore, we are going to emphasize distinct periods taking into account the Federal Constitution of 1988 as a landmark. Starting from bibliographical sources in the accounted for areas of knowledge: law, sociology and anthropology, we are going to analize the ideology of the family which is responsible for inserting itself by the use of patterns which are kept as social structure.
