Experiência estrangeira na implementação de métodos alternativos de resolução de litígios: análise comparativa

O artigo tem como objetivo divulgar a implementação de formas alternativas de resolução de disputas e conflitos jurídicos. Está fundamentado que a busca por alternativas aos tribunais estaduais para resolução de litígios se deve aos seguintes fatores como a consciência jurídica da sociedade, o estado, a cultura jurídica, legislação clara, a adoção de decisões judiciais válidas, a estrutura do sistema judicial, a eficácia do seu trabalho, o nível de desenvolvimento e complexidade das relações económicas e outras relações público-jurídicas. Os procedimentos alternativos de resolução de litígios incluem medidas extrajudiciais e conciliatórias de resolução de litígios. O direito europeu distingue cinco tipos de procedimentos extrajudiciais de resolução de litígios: arbitragem, intervenção de um inspector do trabalho ou mediador, conciliação, mediação e ADR (instrumentos alternativos de resolução de litígios que envolvem os parceiros sociais). Os autores concluem que a ADR é utilizada em muitos países europeus, mas há nuances específicas de cada país na sua aplicação. Os procedimentos alternativos de resolução de litígios podem ocorrer em qualquer fase do litígio, mas é importante escolher um que atenda aos interesses de ambas as partes a fim de garantir a resolução mais rápida, eficaz e barata dos litígios.
