A hipervulnerabilidade do idoso no superendividamento: as intersecções jurídicas entre o Público e o Privado a determinar políticas públicas sob o viés da solidariedade na fase pré-contratual

O objeto desta tese é a consolidação de ações para políticas públicas, a partir do marco teórico do princípio da solidariedade, dentro do processo de intersecções jurídicas entre o Público e o Privado, voltadas à prevenção do superendividamento do idoso que, no âmbito dos contratos de crédito consignado, é consumidor de vulnerabilidade agravada. A relevância do tema se revela em face das práticas mercantilistas perpetradas pelas instituições financeiras que, pela violação ao direito de o idoso ser informado com lealdade, transparência e responsabilidade, têm estimulado excessivamente o consumo e concedido o crédito de forma irresponsável, potencializando o risco do superendividamento.Downloads
