El debido proceso en la jurisdicción penal y el estado de derecho en El Salvador

La protección y garantía del debido proceso es esencial y básico en el Estado de Derecho. La Democracia moderna exige cumplir un estándar de acceso y protección de los derechos fundamentales por parte de los tribunales independientes. Todo acusado tiene derecho a un haz de garantías. Tanto la Constitución, el Código Procesal Penal y el sistema interamericano son una fuente normativa obligatoria para el sistema de seguridad y el de justicia, es decir, para el Estado salvadoreño en su totalidad. Lo anterior implica una constante exigencia de los ciudadanos para que se asegure su cumplimiento.
