The mediation of the senses and the senses of mediation

One of the biggest challenges for an effective access of justice is the construction of a new rationality for the social conflicts composition. Talking about rationality in the present paper is to talk about the promising conflicts mediation practice. Therefore, the purpose here is to present a theory of mediation focused on its communicational aspect as a guiding principle. Directing the studies to discursive practices, it is aimed to demonstrate how the differences between communicational focuses imply in the practice of mediation as a negotiation of senses. As a result, it is presented one concept (and one sense!) of mediation considered the appropriate one for the purpose of democratizing the access of justice.
