Abstract

The present article problematizes the judicialization of the public policies from the construction of a legal culture that uses the argument of authority in the legal discourse. Analyzing the content of sentences granting the Continuous Benefit, the article reflects on a habitus that values a jurisprudential right regardless definition put by public policy.
