About the extension of the material scope of the Vienna Convention on Contracts for the International Sale of Goods

Abstract

According to articles 1.1, 2 and 3 of the CISG this uniform law governs the contracts of sales. Despite the fact that this substantive scope is apparently narrow, the author demonstrates that it has been extended by two ways: Firstly, by the CISG itself in article 3. Secondly, by the doctrine and case law who have expanded the substantive sphere of application of the CISG by applying it to contracts that fall outside the concept of sales.
