The Brazilian State and the social inclusion of persons with disabilities in social relations

The present study aims to analyze the function of the State in the social inclusion of people with disabilities. For this, the historical development of the State position in relation to that vulnerable group is analyzed. The brazilian State, on the other hand, has made significant progress in the protection of people with disabilities by incorporating into its legal system the International Convention on the Rights of Persons with Disabilities and its Optional Protocol signed in New York on March 30, 2007. After, the Brazilian Law on the Inclusion of Persons with Disabilities was promulgated, which prompted even greater development in Brazilian legislation. However, there are still many barriers to be overcome in order for the social inclusion of people with disabilities to take place in brazilian society. In another respect, the social relations of persons with disabilities are analyzed within the framework of their civil capacity and civil law researchers must have a new view about the theme.
