Abstract

This paper shows the two main ways of thinking the phenomena of crime and punishment. One, as a history of ideas about punishment; the other, as a political economy of punishment. By opting for the second way as a method of reflection, in addition to elements brought from psychoanalysis, one comes to the conclusion that the criminal law is unable to function as an instrument of crime control in contemporary neoliberal societies.
