Sharing economy: the algorithmic logic of virtual platforms and the need to protect the person in the current employment relationships

The sharing economy, driven by technological evolution, has transformed the way employers relate to workers and brings into question the extension of the application of labor law to the 21st century workers. Thus, the objective of the present study is to analyze the new form of work organization in this contemporary scenario and to verify the adequacy of the criterion of subordination in order to protect workers or if the subordination criterion should be adopted. For this, the method of approach used was the deductive, along with the historical procedure. It is concluded that the modern dimensions of subordination are sufficient to frame the workers as employees, and, therefore, there must be a presumption of the employment relationship in this hypothesis.Downloads
