The effectiveness of international treaties: an analysis of the case workers from Fazenda Brasil Verde x Brazil in the Inter-American Court of Human Rights

Esse artigo se propõe a realizar uma análise da sentença no caso Trabalhadores da Fazenda Brasil Verde versus Brasil, que tramitou perante a Corte Interamericana de Direitos Humanos, a partir da sentença emitida pela CIDH, no qual a Corte estabeleceu uma série de artigos da Convenção Americana de Direitos Humanos que não estavam sendo cumpridos pelo Brasil, dentre eles, a efetividade do acesso ao judiciário para os trabalhadores vítimas de trabalho análogo à escravidão. O estudo realizado é de natureza qualitativa descritiva, desenvolvido por meio de consultas documentais e bibliográficas, principalmente das fontes extraídas da instituição internacional envolvida. Conclui-se que mesmo sendo o Brasil condenado a efetuar reparação de danos aos trabalhadores da Fazenda Brasil Verde, bem como a reconstituição do processo penal contra os proprietários da Fazenda, os trabalhadores por sua vez, somente após decorridos mais de 20 anos da primeira constatação de trabalho escravo na Fazenda, finalmente obtiveram acesso à prestação jurisdicional após a atuação da Corte Interamericana.
