Notes on theoretical and legal concepts of femicide

The category of femicide, used to designate the deaths of women resulting from gender-based violence, has won, in Brazil, broad support in the social sciences, feminist political practice and law. Despite this wide acceptance, there is no consensus as to its precise meaning and conceptual scope. Although it is understandable that there are many interpretations when a concept is used as a political instrument, using a vague definition in the space of scientific research and law can lead to problematic consequences. This work therefore aims to deconstruct the term and highlight the difficulties arising from the imprecise definition of this phenomenon. Further, theoretically, we intend to bring methodological suggestions that collaborate with continuing research on the theme, and a legal interpretation (within the scope of the law) is proposed for the Brazilian typification, which fulfills the intentions of feminist theory and militancy, yet without signifying an ipso facto strengthening of penal punitivism.
